Trademark applications covering Nice Class 33, which includes alcoholic beverages, are now being accepted in the United Arab Emirates (UAE).

Previously, national trademark registration was not possible in the UAE for alcoholic beverages falling under Class 33. Following a change in the practice of the UAE Trademark Office, applications in this class can now be filed.

Class 33 covers alcoholic beverages other than beer, as well as certain products used in preparing alcoholic beverages.

Significance for trademark owners

This development is particularly significant for foreign alcoholic beverage producers and brand owners who export to the UAE or are planning to enter this market.

Companies with Class 33 trademarks that are used, or planned for use, in the UAE would benefit from reviewing their existing trademark portfolios and evaluating this new registration opportunity. The opening of a class that was previously closed to applications may lead to an increase in new filings, and potentially in trademark conflicts, going forward.

At Juniper IP, we support companies both with trademark proceedings in Turkey and with the protection of international trademark portfolios.

Companies operating in, or planning to export to, the UAE market are advised to assess the protection status of their existing trademarks and, where necessary, to reconsider their filing strategies.
